A request by Lopez Company for a Minor Use Permit (DRC2019-00266) to allow construction of a 1,902-square-foot modular building for farm support quarters on a 277-acre parcel in Tract 2408 (Phase II), an agricultural cluster subdivision. The project will result in the disturbance of approximately 2,000 square feet of the 277-acre parcel. The proposed project is within the Agriculture land use category and is located at 301 Tally Farms Road, approximately 0.5 miles southwest of the Talley Farms Road and Lopez Drive intersection, approximately four miles northeast of the City of Arroyo Grande. The site is in the San Luis Bay (Inland) Planning Area. Also to be considered is the environmental determination that the project is categorically exempt under CEQA, pursuant to CEQA Guidelines Section 15061(b)(2). A request by Karen Tallent for a Minor Use Permit (DRC2018-00108) to authorize a 500-square-foot commercial farm stand for olive oil tasting and retail sales to be located either outside on an existing patio adjacent to an existing 3,600-square-foot barn, or inside a portion of the existing barn. Either way, the barn will be used for the storing, bottling, packaging, and labeling of olive oil (grown from on-site olives). The applicant is requesting a modification to the ordinance standard to allow a reduced setback to 293 feet to an existing residence. This approval does not authorize any temporary events. All signage/banners shall be in accordance with the standards of Chapter 22.20 of the Land Use Ordinance. The project may result in minimal site disturbance for access improvements on a 15.73-acre parcel. The proposed project is located within the Agricultural land use category and is located at 4455 East Highway 41 approximately 4.5 miles east of the City of Atascadero. The site is in the El Pomar-Estrella Sub Area of the North County Planning Area. Hearing to consider a request by Almond Heights, LLC for a Lot Line Adjustment (SUB2019-00068/COAL19-0060) to adjust the lot lines between four (4) parcels of approximately 21.42, 12.64, 12.86, and 5.96 acres each. The adjustment will result in four (4) parcels of 8.54, 20.22, 11.77, and 12.50 acres each, respectively. The adjustment will remediate previous mapping errors and will not result in the creation of any additional parcels. The proposed adjustment is within the Residential Rural, and Residential Suburban land use categories and is located 100 feet west of 19th and Locust Street, adjacent to the City of Paso Robles. The site is in the Salinas River Sub Area of the North County Planning Area. A request by Jane Buffuna and Jon Negranti for the approval of a Reclamation Plan Amendment/Minor Use Permit (DRC2007-00016) for Whale Rock Quarry (Mine ID #91-40-0010) to cover an expanded mining area within a 229.73-acre area of vested mining rights on two assessor’s parcels totaling 234 acres. The Whale Rock Quarry site was “vested” by the Board of Supervisors and is therefore authorized to operate without a Conditional Use Permit. However, the State of California Surface Mining and Reclamation Act, Public Resources Code Section 2774, and County of San Luis Obispo Land Use Ordinance Chapter 22.36 requires approval of a Reclamation Plan covering the entire area proposed for disturbance. The proposed Reclamation Plan Amendment (RPA) will result in reclamation-related activities on mined or disturbed area over a total of approximately 82 acres (19 acres already disturbed and 63 acres to be disturbed following approval of the RPA). Reclamation will occur concurrently with extractive operations as final contours are reached; mining is proposed in four phases spanning approximately 200 years, with Final Reclamation of the mining area anticipated to be completed by 2220. The proposed project is within the Agriculture land use category and is located at 1424 Old Creek Road, approximately 1.3 miles northeast of the community of Cayucos. The site is within the Adelaida Sub Area of the North County Planning Area. Also to be considered at the hearing will be adoption of the Environmental Document (ED18-111) prepared for the item. The Environmental Coordinator, after completion of the initial study, finds that there is no substantial evidence that the project may have a significant effect on the environment, and the preparation of an Environmental Impact Report is not necessary. Therefore, a Negative Declaration (pursuant to Public Resources Code Section 21000 et seq., and CA Code of Regulations Section 15000 et seq.) has been issued on December 12, 2019 for this project. \

A request by Eric Powers for a Minor Use Permit (DRC2018-00195) to establish 1.97 acres of outdoor cannabis cultivation which includes up to 5,000 square feet of hoop houses, the use of one 320-square-foot shipping container for temporary cannabis storage, installation of one 5,000-gallon water tank, and use of an existing 1,224-square-foot barn for pesticide and fertilizer storage. The project will result in the disturbance of approximately 2.08 acres on a 30.68-acre parcel. A modification from the setback standards set forth in Section 22.40.050.D.3.b of the County’s Land Use Ordinance is requested to reduce the setback from 300 feet to 201.5 feet from the northwestern property line. The project site is within the Agriculture land use category at 2979 Clark Valley Road, about three miles east of the community of Los Osos in the Estero Planning Area. Also to be considered at the hearing will be adoption of the Environmental Document prepared for the item. The Environmental Coordinator, after completion of the initial study, finds that there is no substantial evidence that the project may have a significant effect on the environment, and the preparation of an Environmental Impact Report is not necessary. Therefore, a Mitigated Negative Declaration (pursuant to Public Resources Code Section 21000 et seq., and CA Code of Regulations Section 15000 et seq.) has been issued on September 9, 2019, for this project. Mitigation measures are proposed to address Biological Resources and are included as conditions of approval.
