Hearing to consider a request by Green Gold Organic Collective for a Conditional Use Permit (DRC2019-00091), previously a Minor Use Permit (DRC2018-00034), to establish 26,136 square feet (0.60 acres) of outdoor cannabis cultivation in hoop houses. The project would result in approximately 35,000 square feet (0.8 acres) of site disturbance on a 58.12-acre parcel, including approximately 25 cubic yards of cut and fill. The project site is within the Agriculture land use category located at 3033 Mt. Lowe Road, approximately 0.35 miles east of U.S. Highway 101 on the East Cuesta Ridge. The site is within Los Padres Sub Area of the North County Planning Area. Also to be considered at the hearing will be adoption of the Environmental Document prepared for the item. The Environmental Coordinator, after completion of the initial study, finds that there is no substantial evidence that the project may have a significant effect on the environment, and the preparation of an Environmental Impact Report is not necessary. Therefore, a Mitigated Negative Declaration (pursuant to Public Resources Code Section 21000 et seq., and CA Code of Regulations Section 15000 et seq.) has been issued on January 30, 2020, for this project. Mitigation measures are proposed to address Biological Resources and Transportation and are included as conditions of approval.

Request by Avila Valley Partners LLC for a Vesting Tentative Tract Map (TR 3117) and a concurrent Conditional Use Permit (SUB2018-00026) to subdivide an existing 22.76 acre parcel into a Cluster Subdivision of 23 lots consisting of: 22 residential parcels ranging from 0.3 to 1 gross acre in size, one non-buildable open space parcel (11.5 gross acre), and the construction of 22 single family residences of approximately 2,500 square feet (average) including garages on each residential lot. The 22 residential lots will be for sale and/or development. The project will include off-site frontage road improvements and will result in the disturbance of approximately 10.1-acres of the 22.76-acre parcel. The division is proposed in two phases and will create two on-site private access roads: Phase 1 (Valle Verde Place serving 13 lots) and Phase 2 (Tierras Atlas Avenue serving 9 lots). Each phase will include associated access road and utility installations. The project includes a request to modify the street improvement standards as allowed by LUO Section 21.03.020(c)(d) to allow a private access easement to serve more than 5 parcels in each phase. The project is within the Residential Suburban land use category and is located on the west side of Ontario Rd and Highway 101, approximately 1.5 miles northeast of the community of Avila Beach. The site is within the Urban Reserve Limits of the unincorporated community of Avila Beach in the San Luis Bay Inland Sub Area of the San Luis Obispo Planning Area.

Hearing to consider a request by the Port San Luis Harbor District for a Minor Use Permit / Coastal Development Permit (DRC2019-00161) to allow the outdoor storage of seatrain containers in a portion of the Avila Beach Parking Lot totaling approximately 20,000 square feet. The project is within the Recreation land use category; and is located at 450 Second Street in the community of Avila Beach. The site is in the San Luis Bay Coastal Planning Area.
This project is found to be statutorily exempt from the California Environmental Quality Act under the provisions of Public Resources Code section 21080(b)(5), which provides that CEQA does not apply to projects which a public agency rejects or disapproves.

Hearing to consider a request by the County of San Luis Obispo to approve amendments to the Coastal Zone Land Use Ordinance, Title 23 of the County Code, to establish residential vacation rentals standards for the community of Los Osos, under Section 23.08.165. This project is covered by the general rule that CEQA applies only to projects which have the potential for causing a significant effect on the environment. It can be seen with certainty that there is no possibility that this project may have a significant effect on the environment; therefore, the activity is not subject to CEQA.

Hearing to consider and recommend approval to the Board of Supervisors a request by the COUNTY OF SAN LUIS OBISPO to: 1) amend and update the Estero Area Plan, Part II of the Land Use and Circulation Element of the County General Plan and Local Coastal Plan, by updating the Los Osos Urban Area, including goals, policies, programs, and planning areas standards, for the area within and outside of the existing Los Osos Urban Reserve Line, known as the ‘Los Osos Community Plan’, and making other related changes to the Area Plan; 2) amend the Official Maps, Part III of the Land Use Element of the County General Plan, to reflect changes to land use categories and combining designations; and 3) amend and update the Growth Management Ordinance, Title 26 of the County Code, to establish a growth rate for new dwelling units in the Los Osos Urban Area and cleanup ordinance language. Also to be considered at the hearing will be consideration of the Environmental Document prepared for the Los Osos Community Plan. The Environmental Coordinator, after completion of the initial study, finds that there is evidence that the project may have a significant effect on the environment, and therefore a Final Environmental Impact Report (FEIR) was prepared (pursuant to Public Resources Code Section 21000 et seq., and CA Code of Regulations Section 15000 et seq.) for this project. The Final Environmental Impact Report (FEIR) addresses potential impacts to: aesthetics, air quality, biological resources, coastal hazards, cultural resources, tribal cultural resources, hydrology and water quality, land use, noise, transportation and circulation, wastewater, water supply, recreation, population and housing, public services, greenhouse gas emissions, and cumulative impacts. The FEIR also considers alternatives to the project in addition to the “no project” alternative. Also, to be considered are a mitigation monitoring plan, CEQA findings, and overriding considerations.
