A request by Kelly Byde for a Minor Use Permit / Coastal Development Permit (DRC2018-00070) to allow the demolition of two existing single family residences on a parcel; 920 square feet and 730 square feet each and to allow the construction of a new two-story, 2,036 square foot single family residence with an attached 463 square foot garage. The project will result in the disturbance of the entire 4,792 square foot parcel. The proposed project is within the Residential Single-Family land use category and is located at 18 10th Street in the community of Cayucos. The site is in the Estero planning area. Also to be considered is the environmental determination that the project is categorically exempt under CEQA, pursuant to CEQA Guidelines Section 15061(b)(2). A Notice of Exemption has been prepared pursuant to CEQA Guidelines Section 15062.

A request by Jim and Sharon Kroll for a Minor Use Permit / Coastal Development Permit to allow for the construction of a split-level, 2,374 square foot single family residence, an attached 1,378 square foot garage, and a 3,655 square foot barn. Other improvements include two septic systems, landscaping, an agricultural well, and access improvements (Figures 2 and 3). Two portions of the site, totaling roughly 3.03 acres, are proposed as Open Space and Habitat Conservation Plan (HCP) easement areas. The Open Space easement will allow for limited agricultural production; the HCP easement will be used to provide restored native dune scrub habitat for listed species. The project will result in disturbance of approximately 27,443 square feet (0.63 acres) on a 221,696 square foot (~5 acre) parcel. The project is within the Residential Suburban land use category and is located at 302 Madera Street, in the community of Los Osos, in the Estero Planning Area. Also to be considered at the hearing will be adoption of the Environmental Document prepared for the item. The Environmental Coordinator, after completion of the initial study, finds that there is no substantial evidence that the project may have a significant effect on the environment, and the preparation of an Environmental Impact Report is not necessary. Therefore, a Mitigated Negative Declaration (pursuant to Public Resources Code Section 21000 et seq., and CA Code of Regulations Section 15000 et seq.) has been issued on December 5, 2018 for this project. Mitigation measures are proposed to address aesthetics, air quality, biological resources, public services/utilities, recreation, transportation/circulation, wastewater, and water/hydrology and are included as conditions of approval. The Environmental Document is available for public review at the Department of Planning and Building, at the below address. A copy of the Environmental Document is also available on the Planning and Building Department website at www.sloplanning.org. A request by Jonathan Airale for a Minor Use Permit (DRC2018-00143) to establish one acre (43,560 square feet) of outdoor cannabis cultivation on a 22.45-acre parcel. The outdoor cultivation would include processing activities consisting of trimming, drying, and storage. Drying would occur within an 1,152 square-foot hoop structure subject to applicable building permits and designed specifically for this type of use and occupancy, and cannabis produced on site would be stored within a secured 160-square-foot seatrain container. No trees or vegetation will be removed for the purpose of the proposed operations and no artificial lighting is proposed. A modification from the setback standards set forth in Land Use Ordinance Section 22.40.050.D.3 is requested to reduce the required setback to the eastern property line from 300 feet to 100 feet. The project is located within the Agricultural land use category located at 6450 Santa Rosa Creek Road approximately 3.75 miles east of the community of Cambria. The project site is located in the Adelaida Sub Area of the North County Planning Area. Also to be considered is the environmental determination that the project is categorically exempt under CEQA, pursuant to CEQA Guidelines Section 15061(b)(2). A Notice of Exemption has been prepared pursuant to CEQA Guidelines Section 15062.

A request by Lance Jubelt for a Minor Use Permit (DRC2018-00062) to allow for the construction of a 5,200 square foot (sf) two story commercial building. The first floor comprises of 3,800 sf which includes warehouse area, storage and office space, and the second floor comprises of a 1,400 sf mezzanine with a conference room and office space. The project also includes the demolition of an existing 630 sf storage garage. The proposed project will result in the disturbance of the entire 10,000 sf site area. The proposed project is within the Commercial Service land use category and is located at 2021 Nipomo Street, approximately 170 feet west of 21st Street, in the community of Oceano. The site is located in the San Luis Bay Sub Area, of the South County Planning Area. Also to be considered is the approval of the environmental determination. A General Rule Exemption (pursuant to CEQA Guidelines 15062) is proposed for this project.

A request by J & S Storage for a Minor Use Permit (DRC2018-00109) to allow for the phased construction of a 4,600 square foot (sf) winery building to include processing, barrel storage/case storage, a 500 square foot tasting room, and a 1,770 sf covered outdoor work area. The project includes a request for 6 special events per year, with no more than 80 attendees, in addition to industry-wide events. The project will result in approximately 5,000 sf of site disturbance on the 130-acre site. The proposed project is within the Agriculture land use category and is located on the north side of Creston Road (at 6992 Creston Road), approximately 1.5 miles east of the Neal Spring Road and Creston Road intersection. The site is located in the El Pomar-Estrella sub area of the North County Planning Area. The Environmental Coordinator finds that the previously adopted Mitigated Negative Declaration is adequate for the purposes of compliance with CEQA because no substantial changes are proposed in the project which will require major revision of the previous Mitigated Negative Declaration, no substantial changes occur with respect to the circumstance under which the project is undertaken which will require major revision of the previous Mitigated Negative Declaration, and no new information of substantial importance has been identified which was not known at the time that the previous Mitigated Negative Declaration was adopted. A request by Steve and Debbie Arnold for a modification of their previously approved Minor Use Permit to allow the addition of a 2,000 square foot (sf) barrel storage building at the existing winery. No changes are proposed to the winery special event program that previously authorized 6 events per year with up to 80 guests and continued participation in wine industry wide events. The proposed project would result in approximately 2,500 sf of site disturbance on an approximately 466 acre parcel. The proposed project is within the Agricultural land use category and is located on the north side of East Pozo Road (at 10 Pozo Road) adjacent to and southwest of the village of Pozo, in the Las Pilitas sub area of the North County planning area. Also to be considered is the environmental determination. A continued hearing (from November 16, 2018) to consider a request by Biddle Ranch Company LLC and AT&T Mobility for a Minor Use Permit (DRC2016-00056) to allow for the co-location, construction and operation of an unmanned wireless communication facility involving: a) the installation of one (1) new 63-foot high steel monopole; b) six (6) 8-foot tall panel antennas stack mounted in two sectors of three antennas each, at a height of 59 feet above grade (measured to top of antennas) on the steel monopole; c) eleven (11) Remote Radio Units (RRUs) located under the proposed panel antennas; d) an additional 182.5 square feet of fenced lease area; e) new equipment cabinets, racks and associated equipment located within the approximately 640 square foot fenced lease area; and f) installation of electrical utility conduit in an approximately 40 foot long utility trench. The project will result in the disturbance of approximately 400 square feet of a 629-acre parcel. The proposed project is within the Agriculture land use category and is located within the parcel addressed 2900 Lopez Drive, approximately 4 miles northeast of the City of Arroyo Grande. The site is in the South County planning area, Huasna-Lopez Sub Area. The Environmental Coordinator finds that the previously adopted Mitigated Negative Declaration is adequate for the purposes of compliance with CEQA because no substantial changes are proposed in the project which will require major revision of the previous Negative Declaration, no substantial changes occur with respect to the circumstance under which the project is undertaken which will require major revision of the previous Negative Declaration, and no new information of substantial importance has been identified which was not known at the time that the previous Negative Declaration was adopted.

A continued hearing (from November 16, 2018) to consider a request by Biddle Creek Company, LLC & SAC Wireless (for Verizon Wireless) for a Minor Use Permit (DRC2018-00087) to allow for the construction and operation of a new wireless communications facility consisting of nine (9) 8’ tall panel antennas, fifteen (15) Remote Radio Units (RRUs), one (1) 6’ diameter microwave dish, and associated equipment, all installed on a new 45’ tall artificial pine tree (“monopine”), located within a 676 square foot lease area, surrounded by a 6’ tall chain-link fence. The project also includes outdoor equipment cabinets and a diesel standby emergency generator, all located on an 84 square foot concrete pad within the proposed lease area. The proposed project will result in the disturbance of approximately 750 square feet (including utility trenching and access improvements) on an approximate 632-acre parcel. The proposed project is within the Agriculture land use category and is located within the parcel addressed 2900 Lopez Drive, approximately 4 miles northeast of the City of Arroyo Grande. The site is in the Huasna-Lopez sub area of the South County planning area. Also to be considered is the approval of the environmental determination. A mitigated negative declaration was issued on October 22, 2018.

A request by GHC Ventures, LLC for a Minor Use Permit (DRC2018-00064) to establish a 21,250 square foot indoor cannabis nursery facility on a 219.22-acre parcel. The project includes the conversion of an existing 9,000 square-foot building and an existing 12,250 square foot building to support 10,692 square feet of nursery space and 7,032 square feet of office space. An additional 4,218 square feet will be used for ancillary storage. No site disturbance, changes to the building footprint or architecture are proposed. A modification from the parking standards set forth in Land Use Ordinance Section 22.18.050.C.1 is requested to reduce the required number of parking spaces onsite from 41 to 10. The project site is located within the Agricultural land use category at 655 Almond Drive, approximately 7 miles west of the community of Shandon in the Shandon-Carrizo Sub area North of the North County Planning Area. Also to be considered is the environmental determination that the project is categorically exempt under CEQA, pursuant to CEQA Guidelines Section 15061(b)(2). A Notice of Exemption has been prepared pursuant to CEQA Guidelines Section 15062.

A request by Gary Spackman of Nouel Riel Cellars Incorporated and Sandra and David Wood of Coastal Elevations for a Minor Use Permit (DRC2018-00018) to establish up to 20,000 square feet of indoor cannabis cultivation on a portion of the 41-acre project site. On-site development would include construction of four new greenhouses totaling 19,920-square feet combined. The project would also use an existing 80-square foot storage shed and a new 160-square foot storage container for materials storage (e.g., pesticides, fertilizer, soil amendments, and potting materials). The project would employ up to six people and would operate seven days per week between the hours of 7:00 AM and 6:00 PM. A modification from the parking standards set forth in the Land Use Ordinance Section 22.18.050.C.1 is requested to reduce the required number of spaces from 40 to 12. The project site is located at 7755 Airport Road on the west side of Airport Road approximately 500 feet south of Estrella Road and 2.7 miles southeast of the community of San Miguel. The site is located in the Salinas River Sub-Area of the North County Planning Area. Also to be considered at the hearing will be adoption of the Environmental Document prepared for the item. The Environmental Coordinator, after completion of the initial study, finds that there is no substantial evidence that the project may have a significant effect on the environment, and the preparation of an Environmental Impact Report is not necessary. Therefore, a Mitigated Negative Declaration (pursuant to Public Resources Code Section 21000 et seq., and CA Code of Regulations Section 15000 et seq.) has been issued on December 5, 2018 for this project.
